EPS-Deck Concrete Deck Forming Systems Terms & Conditions

 

 

By signing the EPS-Deck/Legalett order form you agree to all the provisions below and to hold harmless Legalett and its employees or agents for any errors or omissions in the quantity’s sizes or styles of EPS-deck panels that have been approved by yourself and that you acknowledge that you have full authority to commit the company to the provisions contained herein.

 

Your company knowingly and willingly waives, indemnifies and holds Legalett Canada Inc. harmless against and in respect of any and all claims, demands, suits, action, proceedings, losses, costs, expenses, obligations, liabilities, damages, recoveries and deficiencies including but not limited to interest, penalties and attorneys fees resulting from claims due to the failure of Company to execute it’s responsibilities as they relate to the provisions of this waiver.

 

Provisions

 

Installation Waiver

 

A. I acknowledge and assume all responsibility for the safe installation and bracing of the EPS-Deck in those projects where EPS-Deck is used after purchase.  In addition, I will show due diligence in informing Company staff, customers, and agents of the following guideline on the proper use of such forms.

 

“Shoring and Bracing: Installer is responsible for the design and correct installation of shoring of EPS-Deck forms in accordance with ACI (American Concrete Institute) 347-04 “Guide to Formwork for Concrete” or current applicable codes. Any variance from these standards must be provided and certified in advance by a structural engineer, licensed for the jobsite location and specifications.”

 

Engineering Waiver

 

B. I further assume all responsibility for job-specific engineering prepared by a Licensed Structural Engineer for any and all EPS-Deck projects in which EPS-Deck is used after purchase by my company. Such engineering includes job-specific concrete reinforcing and design specifications. Company assumes all responsibility for compliance with such job-specific engineering for construction done directly or indirectly by the company. In addition company will show diligence in informing Company staff, customer, and agents of the following guideline on the proper use of such forms:

 

“Reinforced Concrete: Installer is responsible for placement of all reinforcing steel in accordance with ACI (American Concrete Institute) 318-05 “Building Code Requirements for Structural Concrete” or current applicable codes. Any variance from those standards must be provided and certified in advance by a Structural Engineer, licensed by the jobsite location and specifications.”
